2. Children Under the Age of 18.

Throughout this Privacy Notice, the term “Personal Data” means any information that identifies, relates to, describes, references, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular individual or device. However, Personal Data does not include any deidentified, aggregated, or anonymized information.

Users who use our certification services (“Professionals”)

• Identifiers: Name, alias, postal address, unique personal identifier, email address, telephone number, profile photograph.
• Personal information categories listed in the California Customer Records statute: Name, signature, address, telephone number, employment, or any financial information. Some Personal Data included in this category may overlap with other categories.
• Protected Characteristics: Sex (including gender), ethnicity, and race.
• Commercial Information: Details of products or services purchased, considered, or returned, purchase histories, and other transaction-related records.
• Internet Activity: Browsing history, search history, IP address, device and operating system information, and interactions with our Websites.
• Inferences: Inferences or preferences drawn from your activities or transactions that may be used to create a profile regarding your preferences or characteristics.
• Other Information: Credentials, pronouns, profession and specialty area, and professional license and certification information.

Other users of the Websites (“Visitors”)

• Identifiers: Unique personal identifier, name and email address.
• Commercial Information: Details of products or services purchased, considered, or returned, purchase histories, and other transaction-related records.
• Internet Activity: Browsing history, search history, IP address, device and operating system information, and interactions with our Websites.
• Inferences: Inferences or preferences drawn from your activities or transactions that may be used to create a profile regarding your preferences or characteristics.

Information You Provide to Us

We collect the following types of Personal Data directly from you when you access or use the Websites or provide it to a third party service provider operating on our behalf:

Professionals

Real name, alias, postal address, unique personal identifier, email address, telephone number, title, and any other identifier by which you may be contacted online or offline. We also collect information about you when you create a profile on our Website, which may include your race, ethnicity, sex, or gender (if you choose to provide it) as well as your specialty area and information about your supervisor and professional status or licenses. In addition, we collect other types of information that you may provide when you use our Websites, fill out a form, create a profile on our Websites, or through your correspondence with us. Our payment processor directly collects your credit or debit card number or other financial information when you make a purchase on our Websites, but we only receive tokenized versions of this information that cannot be used by third parties to make other purchases and are only used for recordkeeping purposes and to process subscriptions/refunds if necessary.

All users

The Personal Data we collect from all users on or through our Websites includes:

• information that you provide by filling in forms on our Websites. This includes information provided at the time of registering to use the Websites or transacting with us through the Websites. We may also ask you for information when you enter a contest or promotion sponsored by us, and when you report a problem with the Websites;
• if you contact us, records and copies of your correspondence (including email addresses);
• your responses to surveys that we might ask you to complete for research purposes;
• details of transactions you carry out through the Websites and of the fulfillment of your orders. You may be required to provide financial information before placing an order through the Websites; and

Information We Collect Through Automatic Data Collection Technologies

As you navigate through and interact with our Websites, we may use automatic data collection technologies to collect certain Personal Data about your interaction with our Websites, including information about your equipment, browsing actions, and patterns. This includes:

• Website Interaction and Performance Monitoring Tools: Our Websites may also use interaction and/or performance monitoring tools (sometimes call tracking scripts, analytics tools, session replay tools, or heatmap tools). Third-Party Use of Cookies and Other Tracking Technologies

Some content, tools, applications, and/or cookies and other technologies, on the Websites are provided by third parties, including advertisers, ad networks and servers, content providers, analytics providers, social media companies, and application providers. These third parties may use cookies alone or in conjunction with web beacons or other tracking technologies to collect information about you when you use our Websites. These partners help us deliver relevant advertising across our sites. For example, we use Google Ad Manager to assist us with the delivery of relevant ads. 4. How We Use Your Information.

We use the categories of Personal Data described in Section 3 for the following purposes:

5. Disclosure of Your Personal Data.

We may disclose Personal Data that we collect or you provide as described in this Privacy Notice:

• to our subsidiaries and affiliates;
• to contractors, service providers, and other third parties we use to support our business. These entities provide IT and infrastructure support services, payment processing services, website security and fraud protection, and other similar services we use to run our business. 6. Offline Collection, Use, and Disclosure of Information.

The majority of information that we collect is obtained through our Websites. We also may collect information offline, where we also try to protect the privacy of your Personal Data. One example involves someone calling us to place an order or to ask questions. When someone calls, we will ask only for the Personal Data we need in order to place the order or to answer the question. There are other ways we could learn of Personal Data offline, and this Privacy Notice does not discuss or try to predict all of those methods or uses. As we mentioned, we will try to treat offline collection, uses, and disclosures consistently with our relevant online practices.

7. Choices About How We Use and Disclose Your Information.

We strive to provide you with choices regarding the Personal Data we have collected about you. We have created mechanisms to provide you with control over your Personal Data:

• Tracking Technologies and Targeted and Behavioral Advertising. We may use certain tracking technologies and integrations, including cookies, to display advertising to you based on your activities of our Websites and Applications and other online activities. These technologies may also record your activities on our Websites, and such recordings may be disclosed and processed by third parties who provide such technologies. These functions help us understand our users and the use of the Websites. If you do not want us to use your contact information to promote our own or third parties’ products and services, you can opt-out by sending us your request at the contact information below. If we have sent you a promotional email, you may click the unsubscribe link in the body of that email to be omitted from future email distributions. This opt-out does not apply to information provided to us as a result of a product purchase, warranty registration, product service experience or other transactions.

However, these third parties may provide you with ways to choose not to have your information collected or used in this way. Non-Discrimination

We will not discriminate against you for exercising any of your privacy rights. Unless the applicable data protection laws permit it, we will not:

• provide you a different level or quality of goods or services; or
• suggest that you may receive a different price or rate for goods or services or a different level of quality of goods or services.

You may also contact us at the contact information below to (a) confirm whether we are processing your Personal Data, (b) request access to, correct, or delete any Personal Data that we have collected about you, and (c) request that we provide a copy of your Personal Data in a portable and readily usable format. We cannot delete your Personal Data except by also deleting your user account. We may not accommodate a request to change or delete your Personal Data if we believe the change or deletion would violate any law or legal requirement or cause the information to be incorrect.

Verification and Authorized Agents

Before we fulfill your request to access, correct, or delete your Personal Data (or any other privacy-related request we receive), we may ask you to provide information that matches the details we already have on file. This could include confirming your name, email address, or other account details. We do this to ensure that only you (or an authorized agent you designate) can access or modify your Personal Data.

If you choose to submit a request through an authorized agent (such as a legal representative or other designated individual), we may require:

• proof that the agent has valid written authority to act on your behalf (such as a signed, written authorization or power of attorney); or
• confirmation from you directly, verifying that the agent is permitted to make the request.

We reserve the right to deny requests from agents who fail to provide sufficient proof of authorization or if we cannot verify the identity of the individual on whose behalf the request is made.

Appeals Process

If we decline to take action on any request you make regarding your Personal Data (for example, a request to access, correct, or delete your information), you have the right to appeal our decision. To file an appeal, please:

9. Jurisdiction-Specific Privacy Rights.

The law in some jurisdictions may provide you with additional rights regarding our use of Personal Data. Your GDPR (EU, Switzerland, and UK) Privacy Rights

If you are a resident of the European Economic Area, Switzerland, or the United Kingdom, you have the additional rights described in our GDPR Privacy Addendum.

10. U.S. Privacy Rights.

This Privacy Notice applies to our processing of Personal Data of U.S. residents, and is designed to help you better understand how we collect, use, and disclose your personal information and, depending on where you reside, how to exercise available rights under various applicable privacy laws in the U.S., including the Nebraska Data Privacy Act, the Texas Data Privacy and Security Act, and similar state laws as they take effect (collectively, the “U.S. Privacy Laws”).

For categories of sensitive personal information that we collect, we only use or disclose such information either with your specific consent when required, or as otherwise permitted by law.

You may opt out of “sales,” “shares,” or “targeted advertising” (as defined by U.S. Privacy Laws) using the methods set forth in “Choices About How We Use and Disclose Your Information,” by contacting us using the contact information below, or, where applicable, by using a Global Privacy Control signal as described in the Global Privacy Control Signals section below.

We do not process personal information for purposes of profiling in furtherance of decisions that produce legal or similarly significant effects.

When data is deidentified (as defined by the U.S. Privacy Laws), we maintain it in deidentified form and will not attempt to reidentify the information.

Depending on where you reside and subject to the provisions of applicable law, you may also have the right to (a) confirm whether we are processing your Personal Data, (b) request access to, correct or delete any Personal Data that we have collected about you, and (c) request that we provide a copy of your Personal Data in a portable and readily usable format.

11. Global Privacy Control Signals.

We also may use automated data collection technologies to collect information about your online activities over time and across third-party websites or other online services (behavioral tracking). Some web browsers permit you to broadcast a signal to websites and online services indicating a preference that they “do not track” your online activities. Because there is no common understanding about what a “do not track” signal means, we do not respond to those signals in any particular way.

Some web browsers and browser extensions permit you to broadcast the Global Privacy Control signal (“GPC Signal”) as specified at to exercise your right to opt out of “sales,” “shares,” and “targeted advertising.” In certain territories, when we detect such a signal, we will make reasonable efforts to respect your choices indicated by a GPC Signal as required by applicable law.

12. Data Security.

We have implemented measures designed to secure your Personal Data from accidental loss and from unauthorized access, use, alteration, and disclosure.

The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password for access to certain parts of the Websites, you are responsible for keeping this password confidential. We ask you not to share your password with anyone.

Unfortunately, the transmission of information via the internet is not completely secure. Although we have implemented measures to protect your Personal Data, we cannot guarantee the security of your Personal Data transmitted to the Websites. Any transmission of Personal Data is at your own risk. We are not responsible for circumvention of any privacy settings or security measures deployed on or through the Websites.

13. Processing of Personal Data in the United States.

In order to provide the Websites to you, we may send and store your Personal Data outside of the country where you reside or are located, including to countries that may not or do not provide an equivalent level of protection for your Personal Data. Your Personal Data may be processed and stored in the United States and federal, state, and local governments, courts, or law enforcement or regulatory agencies in the United States may be able to obtain disclosure of your information through the laws of the United States.

Your Personal Data is transferred by Evergreen to another country only if it is required or permitted under applicable data protection law and provided, however, that there are appropriate safeguards in place to protect your Personal Data. To ensure your Personal Data is treated in accordance with this Privacy Notice when we transfer it to a third party, Evergreen uses Data Protection Agreements between Evergreen and all other recipients of your Personal Data.

14. Changes to Our Privacy Notice.

We may change this Privacy Notice at any time. It is our policy to post any changes we make to our Privacy Notice on this page with a notice that the Privacy Notice has been updated on the Websites’ home page. If we make material changes to how we treat our users’ Personal Data, we will notify you by email to the email address specified in your account and/or through a notice on the Websites’ home page. The date this Privacy Notice was last revised is identified at the top of the page. You are responsible for ensuring we have an up-to-date active and deliverable email address for you, and for periodically visiting our Websites and this Privacy Notice to check for any changes.
